These terms and conditions are the contract between you and Vision Spares Ltd (“us”, “we”, etc). By visiting or using our website you agree to be bound by them.
We are: Vision Spares Ltd, registered in England under company number 07835658. Our registered office is 124 High Street, Midsomer Norton Bath, Radstock, BA3 2DA.

1. Definitions
In this agreement:

2. Intellectual Property
You shall have no rights in respect of any Intellectual Property Rights howsoever used by us in relation to the Goods or Content and you acknowledge that, you shall not acquire any rights in respect thereof and that all such Intellectual Property Rights are and shall remain vested in or controlled by Us. Product images not owned by Us are reproduced courtesy of the manufacturers/suppliers and Intellectual Property Rights remains with them. Images are for illustration purposes only and the actual products may differ from the images shown.
3. Your account with us
You must be aged 18 and over to order a product from this Website and by ordering a product from us you confirm that you are over 18 years of age. You agree that you have provided, and will continue to provide accurate, up to date, and complete information about yourself. We need this information to provide you with the Goods. If you use Our Website, you are responsible for maintaining the confidentiality of your account and password and for preventing any unauthorised person from using your account. You agree to accept responsibility for all activities that occur under your account or password. You should tell us immediately if you believe some person has accessed your account without your authority and also log in to your account and change your password.
4. Acceptance of your order
Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the Goods to you. At any time before the Goods are despatched, we may decline to supply the Goods to you without giving any reason. We will not be obliged to supply any other Goods which may have been part of your order until we actually dispatch the Goods to you.
If we do not have the Goods you order in stock, we may offer you alternatives. If this happens you may accept the alternatives we offer OR cancel all or any part of your order not already dispatched.
5. Price and payment
Forms of Payment
We accept Visa, Mastercard, Delta, Switch, American Express and Solo cards. All payment transactions are processed at time of ordering. Payment information is never taken by us or transferred to us either through our website or otherwise. Our employees and contractors never have access to it.
You may also pay by cheque. Cheques should be made payable to "Vision Spares Ltd". You should allow 7 working days for cheques to clear once received by us, after which the goods will be dispatched (subject to stock availability).
6. Price, Foreign taxes and Duties
The price payable for the Goods that you order is clearly set out on Our Website. It is possible that on occasions the price shown is incorrect or may have increased from that shown on Our Website. If that happens, we will not dispatch the Goods until you have confirmed that you wish to buy at the new price. We will not be liable to supply those Goods to you at the stated price, provided that we notify you before we dispatch it to you. The price of the Goods does not include the delivery charge which will be charged at the rates applicable on the date you place your order and which will be displayed during checkout before we ask you to pay. If you show by your delivery address that you reside in the United Kingdom (“UK”) the price will be shown including Value Added Tax (“VAT”). If you show by your delivery address that you reside in the European Union (“EU”) Orders under €150 will include local taxes and duty. Orders €150 or greater, will not include any customs, duties, additional charges and taxes of any kind levied in your country and these will be borne by you prior to delivery and to the delivery company. If you show by your delivery address that you reside outside of the UK and EU, we have no knowledge of and no responsibility for, the laws in your country. You are responsible for purchasing Goods which you are lawfully able to import and for the payment of any customs, duties, additional charges and taxes of any kind levied in your country. These are not included in the delivery costs. Bank charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than pounds Sterling will be borne by you. Any information given by us in relation to exchange rates are approximate only and may vary from time to time.

8. Machinery Warranty
All machinery comes with a minimum manufacturer warranty of 90 days for manufacturing defects. In the unlikely event that your purchase develops a fault within the warranty period, Vision Spares Ltd must be notified immediately. Vision Spares Ltd will refer you to your local dealership where the product will be examined by a qualified technician and repaired as per the warranty details. This does not affect your statutory rights as a consumer.
Vision Spares Ltd will not be liable for any additional costs incurred whilst goods are away for warranty repairs - this includes rental or hire charges for equipment from a third party.
Whilst in your care, machines should be serviced and inspected regularly by a qualified mechanic.
Please take safety seriously and always read all material and handbooks supplied by the manufacturer before assembling or using the machinery. If you have any doubts do not use the machine and contact ourselves or the relevant manufacturer before use.
9. Warranties and Limitation of Liability
Vision Spares Ltd, its employees and representatives, have taken every care in the preparation of the content of this website. To the extent permitted by applicable law, Vision Spares Ltd disclaims all warranties of any kind, express or implied, as to the accuracy of the information contained on this website or the information, content, materials or products included in this site, including, without limitation, warranties of merchantability, satisfactory quality and fitness for a particular purpose. In addition, Vision Spares Ltd does not represent or warrant that the information accessible via this website is accurate, complete or current. To the fullest extent permitted at Law Vision Spares Ltd shall not be liable for any loss or damage arising out of, or in connection with the use of this website or the information, content, materials or products included on this website. This is a comprehensive limitation of liability and it applies to all damages of any kind, including compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
The prices listed on this website are monitored very closely for accuracy. Occasionally, pricing errors do occur. In the rare event that this may happen you will be notified of the price difference, prior to dispatch.
For the avoidance of doubt, Vision Spares Ltd does not limit its liability for death or personal injury to the extent only that it arises as a result of the negligence of Vision Spares Ltd its employees or representatives. Unless otherwise specifically stated, this website is directed solely at those who access this website from the United Kingdom mainland.
Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that are caused by events, circumstances or causes outside of our control.
If an event outside our control takes place that affects the performance of our obligations, we will contact you as soon as reasonably possible to notify you, or our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control. Where the event outside our control affects the delivery of the products to you, we will arrange a new delivery date with you after the event outside our control is over.
Machinery
Usage of machinery purchased from us is entirely at your own risk. You must ensure any person using the machinery is trained and qualified to use the machinery. Vision Spares Ltd its employees, representatives and suppliers are not liable for any accidents or damage howsoever caused whilst the machine is in your possession. Assembly of the unit is also at your own risk and any problems that may occur from incorrect assembly are not warrantable, nor are the suppliers culpable.

10. Right to Cancel
You have the right to cancel your order(s) under The Distance Selling Regulations which gives consumers extra protection when buying online.
Specific legislation that applies in regulation of The Distance Selling Regulations:
You have the right to cancel the purchase of a good without having to give a reason at any time within the "cooling off period" of fourteen days beginning on the day after you receive the goods.
If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. Goods must be returned in an unused state, preferably in their original packaging to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the contract.
We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation.
11. Notices
All notices you send us must be sent to the contact details on this site ( email - [email protected]). We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.

13. Jurisdiction
These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.
